Terms of Service

The binding legal agreement between you and Qbiqal Technologies Pvt. Ltd. governing use of the platform and all AI services.

1. Definitions

Platform: The Qbiqal SaaS application, APIs, AI Engine, and all related services.

Agency: A business that subscribes to Qbiqal to provide AI services to clients.

Client: A business that subscribes under an Agency to use AI Qbiqals.

AI Employee / AI Qbiqal: An automated AI worker operating within the Platform.

Credits: Platform currency consumed by AI operations.

2. Account Registration

You must provide accurate information when creating an account. You are responsible for maintaining the security of your credentials and for all activities under your account. Notify us immediately of unauthorized access at [email protected].

You must be at least 18 years old and legally authorized to enter into this agreement on behalf of your organization.

3. Acceptable Use

You agree NOT to:

Use the Platform for illegal activities or in violation of applicable Indian law.
Circumvent credit limits, reverse-engineer the AI Engine, or attempt unauthorized access.
Use AI Employees to generate content that is defamatory, obscene, or violates third-party intellectual property rights.
Resell access to the Platform without authorization (except as a licensed Agency).
Upload malicious code, conduct denial-of-service attacks, or scrape the Platform.
Submit personal data of children under 18 to the Platform.

4. Subscription, Credits & Billing

Subscriptions are billed monthly or annually. Credits are consumed by AI operations. Unused credits do not roll over beyond the plan period unless otherwise stated. All prices are in INR or USD as displayed. Taxes (GST) are added where applicable.

Refunds are handled per our Refund Policy. Chargebacks without contacting us first may result in account suspension. Contact [email protected] for billing queries.

5. Data Ownership

You retain ownership of all data you input into the Platform. You grant Qbiqal a limited license to process this data solely to provide the services. We do not use your input data to train AI models.

AI-generated outputs are owned by you, subject to the terms of the underlying AI model providers (Anthropic, OpenAI, Google, etc.).

6. Service Availability

We target 99.5% uptime, excluding scheduled maintenance. Qbiqal is not liable for downtime caused by third-party AI model providers, infrastructure outages, or force majeure events.

7. Intellectual Property

The Qbiqal platform, branding, and software are owned by Qbiqal Technologies Pvt. Ltd. You may not copy, modify, or distribute any part of the Platform without written permission.

8. Limitation of Liability

To the maximum extent permitted by Indian law, Qbiqal's liability is limited to the amount paid by you in the 3 months preceding the claim. Qbiqal is not liable for indirect, incidental, or consequential damages.

AI-generated outputs may contain errors. You are responsible for reviewing and validating AI outputs before use in consequential decisions (medical, legal, financial).

9. Termination

Either party may terminate the agreement with 30 days notice. Qbiqal may suspend or terminate immediately for material breach, fraudulent activity, or non-payment. Upon termination, your data will be handled per our Data Retention Policy.

10. Governing Law

These Terms are governed by the laws of India. Disputes shall be subject to the exclusive jurisdiction of courts in India. We encourage resolution through our grievance process before litigation.

11. Changes to Terms

We will notify you of material changes via email and in-app notification 15 days before they take effect. Continued use after the effective date constitutes acceptance.
